1. Who we are and agreement
These terms are between you and HW2XSOUND NORTH AMERICA (“HW2xSOUND,” “we,” “us,” or “our”), a Georgia-based business in the United States. Contact: HW2xsound@proton.me. By using this site, placing an order, activating a license, or submitting community content, you agree to these terms. If you do not agree, do not use the relevant service.
You must be legally able to enter a contract where you live. If you are under the age required to consent to purchases, ask a parent or guardian to handle the order.
2. Products, prices, and availability
Product pages describe what is currently offered and the formats and contents included. FOUR × THREE plugin-only is listed at $40 USD. The Starter Kit is listed at $100 USD and includes the plugin plus the ten sound libraries shown on the product page. A Starter Kit sale must remain unavailable until all included downloads are prepared and accessible. Paid preset packs are not available for purchase unless a product page explicitly offers checkout.
Prices and product details may change for future orders. The price shown at checkout before you pay is the price for that order. Taxes, if applicable, are shown or collected by the payment provider or as required by law. We do not promise that an announced or planned release date will be met unless a specific delivery date is stated at checkout.
3. Orders, payment, and delivery
Orders are submitted through the payment method shown at checkout. Your payment is processed by the named payment provider; we do not receive or store your full payment-card number. Keep your receipt email and use a working email address. Digital download links and account license cards are delivered to the order email after payment and license processing. Links may expire or be replaced for security.
If a download link fails, a purchased item is missing, or the delivered files do not materially match the product description, contact HW2xsound@proton.me with the order email and a description of the issue. We will investigate and, where appropriate, restore access, provide a correction, or issue a refund.
4. Refunds and consumer rights
Digital software and sound libraries can be copied after delivery, so please check the compatibility and contents described on the product page before ordering. If you have not received working access, received a duplicate charge, or believe a product is defective or materially misdescribed, contact us promptly so we can fix the problem or review a refund request.
Nothing in these terms removes any cancellation, refund, warranty, or other consumer right that cannot legally be waived where you live. A payment-provider dispute does not replace contacting us about a delivery or technical problem, although you may use any rights your payment provider gives you.
5. Software and license rules
After a valid purchase, we grant you a personal, non-exclusive, non-transferable license to install and use the purchased software and included materials for your own music production, subject to the product’s license limit. The current FOUR × THREE license is intended for up to two computers, subject to the license policy shown at purchase and the activation service’s availability.
- You may use your own created music in personal and commercial projects.
- You may not resell, redistribute, share, upload, sublicense, or publish the plugin, installers, license key, account card, or included sound libraries as standalone products or in a way that lets others extract them.
- You may not use a license card or key assigned to another person, bypass activation, tamper with license checks, or use a purchased license beyond its stated device limit.
- You may not reverse engineer or modify the software except to the extent a restriction is prohibited by applicable law.
Activation checks are handled by the license service described in the activation guide. License validation and activation can depend on third-party services and an internet connection. Offline registration is supported only where the License Manager explicitly offers it and the required signed license data is valid. A local activation record in the manager does not by itself mean that every plugin format has an integrated license check; only rely on access controls stated for the specific release.
Sponsored NFR licenses are for the named recipient, are not for resale, and follow the product and device limits assigned to them.
6. AlgoFarm community uploads
Only native FOUR × THREE .4x3preset files are accepted for the community sharing area. ZIPs and other file types are not allowed. You keep ownership of your original content. By submitting it, you give HW2xSOUND a non-exclusive, worldwide, royalty-free permission to scan, store, review, display, and distribute the submitted preset files and the title, creator name, and description as needed to operate and promote the community bank. This permission ends when the content is removed, except for copies needed for backups, legal records, or a dispute.
You promise that you created the submission or have permission to share it, that it does not violate another person’s rights, and that it contains no malicious code or material that is unlawful or abusive. Do not upload other people’s proprietary samples, copyrighted material, personal information, or content you do not have rights to share.
Uploads are subject to automated file and malware checks and human review. Scanning cannot guarantee detection of every harmful file. We may reject, remove, disable, or limit access to a submission; we may also suspend repeat or abusive uploaders. You are responsible for keeping a safe copy of your files.
Copyright reports
Email HW2xsound@proton.me with (1) your physical or electronic signature, (2) the copyrighted work you identify, (3) the specific community preset or URL you want reviewed, (4) contact information where we can reach you, (5) a statement that you have a good-faith belief the use is unauthorized, and (6) a statement that your report is accurate and, under penalty of perjury, that you own the rights or are authorized to act for the owner. Do not make false claims. We will review the report, may restrict access while investigating, and may notify the uploader.
If you believe material was removed by mistake, email us the exact item, your contact information, a statement under penalty of perjury that the removal was mistaken or misidentified, and the jurisdiction and service-of-process consent required by applicable law. We will follow any statutory counter-notice timelines that apply.
7. Availability and updates
We may update, maintain, or discontinue site features, download links, or online services. We will make reasonable efforts to provide purchased downloads and supported updates, but do not promise uninterrupted access to online services. We may suspend access when needed to protect users, investigate suspected fraud or abuse, or comply with law. Where a change materially affects a paid product or a legal right, applicable consumer protections continue to apply.
8. Warranty and liability
To the extent permitted by law, the site and products are provided as available, and we disclaim implied warranties that can legally be disclaimed. We do not promise that software will be error-free, compatible with every system or DAW, or suitable for every workflow. Product-specific written promises and non-waivable consumer guarantees still apply.
To the extent permitted by law, HW2xSOUND is not liable for indirect, incidental, special, punitive, or consequential loss, including lost profits, lost projects, or lost data. To the extent permitted by law, our total liability for a claim related to a paid order is limited to the amount you paid us for the product giving rise to that claim during the 12 months before the event. These limits do not apply where law does not allow them, including liability that cannot legally be limited.
You are responsible for backing up your projects and presets and for using appropriate security protection on your computer.
9. Governing law and disputes
These terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law rules, except where mandatory consumer law in your country or state requires otherwise. Courts located in Georgia will hear disputes where the law permits. You retain any right to bring a claim in another court that mandatory law gives you.
10. Changes and contact
We may revise these terms to reflect changes to the site, products, or law. The effective date above shows the current version. Changes apply prospectively and do not retroactively remove rights attached to a completed purchase. Questions or support: HW2xsound@proton.me.
